Causes of Eye Injuries Resulting from Medical Negligence

  • Surgical Errors: Mistakes during procedures like cataract surgery or laser treatments can damage eye structures.
  • Improper Medication: Incorrect prescriptions or misuse of eye drops can harm the eye.
  • Misdiagnosis: Failure to accurately diagnose and treat eye conditions can lead to worsening symptoms or additional injuries.

Who Bears the Liability for Your Eye Injury?

Eye injuries can have a profound impact on your life, affecting your ability to work, enjoy hobbies, or even perform everyday tasks.

If your eye injury results from surgical errors, misdiagnosis, or improper treatment, the medical practitioner or facility may be liable.

Can You Bring an Eye Injury Claim?

If you have suffered an eye injury due to someone else's negligence, you may be entitled to compensation. To bring a claim, you generally need to establish that:

  • The person or entity had a legal obligation to ensure your safety.
  • They violated their duty of care by acting or failing to act.
  • This breach directly caused your eye injury.
  • You suffered losses,physical, emotional, or financial,as a result.

The Eye Injury Claim Process

The eye injury claim process starts by contacting our experienced solicitors, who will guide you through each step to secure the compensation you deserve. They will collect all necessary evidence, including medical and expert reports, to build a strong case on your behalf.

If your eye injury resulted from medical negligence, we'll send a formal letter of claim to the defendant. If they accept liability for your injury and we're able to reach a settlement with them, your case will end there. However, if they deny liability or if we can't come to an agreement with them regarding the compensation amount, we'll take your case to court.

Statute of Limitations

The statute of limitations for eye injury claims in Ireland is generally two years from the date of the injury or the date you became aware of the injury. This is outlined in the Statute of Limitations Act, 1957, which governs the time limits for personal injury claims.

Under the Act, this two-year limitation period applies to most personal injuries, including eye injuries, regardless of whether they occurred in the workplace, in a public place, or as a result of medical negligence. Sometimes the limitation period starts from the "date of knowledge",the date you first became aware of the injury,if the injury was not immediately apparent.

What Is the Average Compensation for Eye Injuries in Ireland?

Various factors, including those outlined in the Personal Injuries Guidelines, will influence the compensation you can expect for an eye injury. These factors include:

  • Age: Younger claimants may receive higher compensation due to the longer-lasting impact of the injury on their life.
  • Impact on Quality of Life: How the injury affects your ability to perform daily activities, engage in hobbies, and enjoy life overall.
  • Effect on Employment: Whether the injury limits your ability to continue in your current job or affects your career prospects.
  • Interference with Personal Relationships: The extent to which the injury impacts your relationships with family and friends.
  • Loss of Independence: Whether the injury results in the need for assistance with daily tasks or reduces your ability to live independently.
  • Cosmetic Impact: The visible effect of the injury, such as scarring or disfigurement, which could affect self-esteem or social interactions.
  • Psychological Impact: The emotional and mental effects, such as depression or anxiety, that result from the injury.
  • Severity of the Injury: The extent of the injury, whether it results in total blindness, partial loss of vision, or more minor impairments.

Considering these factors, compensation amounts vary:

  • Total blindness: €270,000 to €400,000
  • Loss of one eye or significant vision loss in one eye: €80,000 to €120,000
  • Loss of sight in one eye with reduced vision in the remaining eye: €120,000 to €300,000
  • Serious but not complete loss of vision in one eye: €15,000 to €70,000
  • Minor but permanent impairment of vision in one eye: €15,000 to €45,000
  • Minor injuries with full recovery: €500 to €15,000

Our solicitors will assess these factors to provide a clearer estimate based on your specific case.
