The firm recently acted for a young man who had suffered a sporting injury and subsequently came under the care of a Consultant Orthopaedic Surgeon. Our client underwent initially successful surgery to repair his injury but was subsequently advised by the surgeon that further surgery would improve matters further. Our client was not advised that this subsequent surgery carried with it a significant risk of nerve injury.

It was our client’s case that had he been advised of this significant risk, he would not have consented to further surgery given his family circumstances and the fact that he had made a very considerable and almost full recovery from the initial surgery.

Our client unaware of the risks involved underwent the surgery and the known risks of nerve injury occurred. Our client suffered a myriad of difficulties and very significant pain as a result of this.

Liability was not admitted but the settlement of €375,000 will allow for future surgeries if necessary, orthotics and specialised shoes.
